Tell NM to Reject Project Jupiter's Pollution Permit

Project Jupiter is a massive AI data center planned for Doña Ana County. Its developers say it will run on clean fuel sources, but those fuel cells still burn dirty gas and need a huge new pipeline that doesn’t even exist yet. If built, this project would release about 10 million tons of pollution a year and lock New Mexico into gas dependence for decades.

State regulators are deciding now whether to approve the air pollution permit. Denying the permit could stop the project in its tracks.

Dear Chair Ely and Board members,

I am writing to oppose the air quality permit for the Project Jupiter data center in Doña Ana County. I urge the Board to deny the permit.

This project still depends on fossil fuels.

Project Jupiter’s developers dropped their plan for gas turbines and switched to fuel cells instead. While this cuts a small amount of pollution, it does not cut the project’s need for fossil fuels. The fuel cells run on natural gas, up to 400 million cubic feet a day, delivered through a pipeline that hasn’t even been approved yet. The State Lands Office already rejected one request to build the pipeline. The Board should not approve a permit for a project whose power source does not legally exist yet. 

Pollution as much as Albuquerque, Santa Fe, & Las Cruces Combined

The developers say their new plan reduces emissions. In reality, it’s only a 5-10% cut. This project would still release about 10.1 million tons of greenhouse gases per year, as much as Albuquerque, Santa Fe, and Las Cruces combined. That's not acceptable, and it goes against New Mexico's target of reaching net zero emissions by 2050.

A Process that Fails to be Fair and Transparent

Other parties in this case have raised real concerns about the last minute schedule changes, limited access to records, and fake public comment submissions. Doña Ana County, and all New Mexicans, deserve a process they can trust.
 
New Mexico should not trade decades of fossil fuel dependence for short-term economic gain. Real development doesn’t come at the cost of our air, climate or health of frontline communities.

I urge the Board to deny this permit.
